Evality.ai (“Evality” or “Platform”) provides an AI-driven HR technology platform designed to automate candidate screening, evaluation, and related HR processes. By accessing or using Evality, you agree to be legally bound by these Terms and Conditions (“Terms”). These Terms govern your use of all Evality services, features, and functionalities.

2. User Accounts

• Users must provide accurate, complete, and current information during account registration.
• Users are responsible for maintaining account confidentiality and security.
• Evality reserves the right to suspend or terminate user accounts without prior notice in case of violation of these Terms, suspicious activities, or unlawful conduct.

3. Use of the Platform

• Users are permitted to access Evality's services solely for legitimate recruitment and HR-related purposes.
• Users are prohibited from using the Platform to engage in illegal activities, infringe upon intellectual property rights, or transmit harmful or offensive content.
• Users must ensure the accuracy and legality of all information submitted to Evality.

4. Intellectual Property

• Evality retains exclusive ownership of all intellectual property rights, including software, algorithms, data models, platform content, and branding.
• Users receive a limited, non-exclusive, non-transferable license to access and use the Platform strictly as permitted by these Terms.
• Any unauthorized use, reproduction, or distribution of Evality's intellectual property is strictly prohibited.
• Users must immediately notify Evality in writing of any suspected intellectual property violations.

5. AI-Driven Services

• Evality employs AI technologies for automated candidate screening, evaluation, and related HR functions.
• Users are responsible for ensuring the accuracy and legality of the data inputs provided to Evality's AI systems.
• Evality provides transparency regarding the criteria and rationale for automated decisions. Users acknowledge and accept the limitations inherent to automated decision-making processes.
• Users may request human review or appeal AI-generated decisions within a reasonable timeframe.

6. Confidentiality

• Users must protect and maintain the confidentiality of sensitive information obtained through Evality.
• Evality commits to handling user data securely and confidentially in compliance with applicable laws and regulations.

7. Data Privacy

• Evality's collection, processing, and protection of personal data comply with its Privacy Policy, which users acknowledge and accept upon platform usage.
• Users acknowledge Evality's right to process user data for service provision, analytics, and product improvement purposes.

8. Third-Party Services

• Evality may integrate third-party services and APIs to enhance its functionality.
• Evality disclaims any responsibility or liability related to the performance, accuracy, or reliability of third-party services.

9. Disclaimers and Limitations of Liability

• Evality provides its platform “as-is” without guarantees regarding the accuracy, completeness, or reliability of generated data or outcomes.
• Evality expressly disclaims warranties of any kind, whether express, implied, or statutory.
• Evality shall not be liable for any indirect, incidental, consequential, punitive, or exemplary damages resulting from or related to the use or inability to use the Platform, even if Evality has been advised of such possibilities.

10. Indemnification

Users agree to indemnify, defend, and hold harmless Evality, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys' fees) arising from user misuse, breach of these Terms, or violation of applicable laws.

11. Modifications to Terms

• Evality reserves the right to update or modify these Terms at any time without prior notice.
• Users will be notified of significant changes through the Platform or via email.
• Continued use of the Platform after such updates constitutes acceptance of the revised Terms. Updates are effective immediately upon posting.

12. Governing Law and Jurisdiction

• These Terms shall be governed by and construed under the laws of India.
• Users irrevocably agree to the exclusive jurisdiction and venue of courts located in Bangalore, Karnataka, India, for any disputes arising from or related to these Terms or platform usage.

13. Termination

• Evality reserves the right to terminate or suspend user access immediately for violations of these Terms, suspicious activities, or legal compliance issues.
• Users may terminate their accounts at any time, subject to the termination procedures provided by Evality.
• Upon termination, Evality may retain or delete user data in accordance with its Data Retention Policy.
